These Terms of Service (“Terms”) govern your access to and use of the Taft360 website, online store, customer portals, and all related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Use of the Services
You must be at least 18 years old to use our Services. You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
You agree that you will not:
• Interfere with or compromise the security or integrity of the Services
• Attempt to gain unauthorized access to any systems, data, or accounts
• Use the Services for fraudulent, harmful, or deceptive purposes
Taft360 may revoke access to any user or organization that violates these Terms or misuses the Services.
2. Account Registration
Certain features require an account or portal login. You agree to:
• Provide accurate, current information
• Maintain the confidentiality of your login credentials
• Accept responsibility for all actions taken under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Product Availability & Descriptions
Product availability, pricing, and specifications may change without notice. While we strive for accuracy, product images and descriptions may vary, especially for custom or manufacturer-produced items.
We reserve the right to limit or cancel quantities purchased per customer, per agency, or per order.
4. Custom & Special-Order Items
Custom-decorated items—including embroidery, screen printing, DTF, HTV, sublimation, tailoring, and other customizations—are produced according to customer specifications and are non-returnable and non-refundable, unless defective or due to a Taft360 error.
Once production begins, custom orders cannot be modified or canceled.
5. Pricing & Billing
Prices displayed on the website or in customer portals reflect applicable retail or contract pricing. Taft360 reserves the right to correct pricing errors at any time.
By placing an order, you authorize Taft360 to charge the payment method provided for the full order amount, including product costs, taxes, shipping, and applicable fees.
6. Shipping
Shipping timelines, methods, and fees are governed by our Shipping Policy, which forms part of these Terms. Once an order is transferred to the shipping carrier, responsibility for transit lies with that carrier.
7. Returns & Exchanges
Return eligibility follows our Return Policy.
Custom, special-order, worn, used, or altered products are not eligible for return.
All returns require adherence to the procedures stated in the Return Policy.
8. Warranties & Disclaimers
Except where prohibited by law, Taft360 provides the Services and all products “as is,” without warranties of any kind, either express or implied.
This includes, but is not limited to:
• Merchantability
• Fitness for a particular purpose
• Non-infringement
Manufacturer warranties, when applicable, are governed by the manufacturer’s terms.
9. Limitation of Liability
To the fullest extent permitted by law, Taft360 and its owners, employees, affiliates, and representatives are not liable for any indirect, incidental, consequential, or punitive damages arising from:
• Use of or inability to use the Services
• Product purchases
• Shipping delays or carrier-related issues
• Unauthorized access, data breaches, or data loss
Total liability for any claim shall not exceed the amount paid for the related product or service.
10. Indemnification
You agree to indemnify and hold harmless Taft360 and its representatives from any claims, losses, liabilities, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.
11. Intellectual Property
All website content—including text, graphics, product data, images, videos, and branding—is owned by Taft360 or its partners and protected by applicable copyright and trademark laws.
Unauthorized copying, distribution, or modification is prohibited.
12. Third-Party Links
The website may contain links to third-party sites. Taft360 is not responsible for the content, accuracy, or privacy practices of third-party websites.
13. Termination
We may suspend or terminate your access to the Services at any time—for any reason, including:
• Fraud or misrepresentation
• Violations of these Terms
• Unauthorized activity
• Harmful conduct
Upon termination, all rights granted to you under these Terms immediately cease.
14. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. All disputes will be resolved in Wisconsin courts.
15. Modifications to the Terms
We may update or revise these Terms at any time. Updates become effective upon posting. Continued use of the Services constitutes acceptance of any changes.
